1. Purpose and scope
This Recurring Payments Policy explains how Luvio stores your card details and uses them for payments that happen after your first purchase. It covers both scheduled recurring transactions (such as the automatic renewal of a Luvio Premium subscription) and unscheduled transactions made on a stored card.
It applies to every user of the Luvio website and mobile application who subscribes to Luvio Premium or saves a card for future purchases. It forms part of our Terms and Conditions and should be read with our Payment Policy.
The Service is operated by LUVIO CLUB LIMITED, company number 17393545, registered office 27 Old Gloucester St, London, WC1N 3AX, United Kingdom. Card payments are processed by our payment service provider, MADFin Tech LTD (company number 11092839).
2. Definitions
- Stored credential — your card details, held in tokenised form by our payment service provider after you have agreed that we may keep them for future payments.
- Cardholder-initiated transaction (CIT) — a payment you actively start yourself, for example by pressing “Buy” on a one-off purchase using your saved card.
- Merchant-initiated transaction (MIT) — a payment we start on your behalf, under an agreement you gave us in advance, without you being present.
- Scheduled recurring transaction — an MIT for a fixed amount taken at a fixed, agreed interval, such as a monthly or annual subscription renewal.
- Unscheduled credential-on-file transaction (UCOF) — an MIT taken on an agreed basis but with no fixed date or no fixed amount, such as a retry of a failed subscription payment.
3. How Luvio uses stored credentials
3.1 Scheduled recurring transactions
Luvio Premium is billed as a scheduled recurring transaction. When you subscribe, you authorise us to charge the stored card the agreed subscription amount at the start of each billing period, automatically, until you cancel. The amount and the interval are fixed and are disclosed to you before you agree.
3.2 Unscheduled transactions
We use unscheduled credential-on-file transactions only in the following cases:
- retrying a subscription payment that was declined, within the retry limits described in section 9;
- collecting an amount that remains due for a billing period already supplied, where an earlier payment was reversed in error; and
We do not use unscheduled transactions for any other purpose, and we do not use a stored card for a product you have not agreed to.
3.3 One-off purchases on a saved card
When you buy a one-off feature using a card you have saved, you start that payment yourself. It is a cardholder-initiated transaction, charged once, at the moment you confirm it. It does not create a recurring arrangement.
4. Your consent
We take a recurring payment only where you have given clear, affirmative consent in advance. Before you agree, and on the same screen as the button that commits you to pay, we show:
- that the payment will repeat automatically and will continue until you cancel;
- the amount of each payment and the currency;
- how often the payment is taken, and the date of the first payment;
- the length of any trial, introductory or promotional period, and the amount and date of the first full charge after it ends;
- the minimum term, if any; and
- how to cancel, with a direct link.
Consent is given by an action you take yourself — ticking a box that is not pre-ticked, or pressing a clearly labelled button. Continuing to use the Service, or failing to opt out, is never treated as consent to a recurring payment.
We keep a record of each consent, including the date and time, the terms you agreed to and the version of those terms, and we can provide it to you or to your card issuer on request.
5. Confirmation when you subscribe
Immediately after you subscribe, we send a confirmation to the email address on your account. It repeats the terms of the arrangement: what you subscribed to, the amount and currency, the billing interval, the date of the next payment, the length of any trial period, the statement descriptor that will appear on your statement, and a direct link to cancel.
6. Receipts for every payment
We send a receipt by email after every recurring payment, without exception. Each receipt shows the date, the amount and currency, the billing period covered, the last four digits of the card charged, the statement descriptor, and a direct link to cancel the subscription.
7. Advance notice before we charge you
In addition to receipts, we send reminders before a payment is taken in the following cases:
- Trial or introductory period ending — at least 7 days before the first full-price payment, we email you a reminder stating the amount and date of that payment and containing a link to cancel online.
- Subscriptions billed every 6 months or less often, including annual plans — at least 7 days before each renewal, we email you a reminder of the amount and date, with a link to cancel.
- Any change to the amount, the billing interval or the terms of the arrangement — at least 7 days before the change takes effect, and at least 10 days before a price increase.
These notice periods reflect the requirements of the Visa and Mastercard rules for subscription and negative-option billing. Where the rules of a card scheme require a longer notice than stated here, the longer period applies.
8. Renewal and billing dates
A subscription renews automatically on the same calendar day of each billing period. Where that day does not exist in a given month, the payment is taken on the last day of that month. Renewal happens at the start of the new period, so that access is continuous.
We charge the amount disclosed to you at the time you subscribed, or the amount notified to you under section 7 if it has since changed.
9. If a payment fails
If a recurring payment is declined, we notify you by email and retry the payment. Retries are limited to 4 attempts within 14 days of the original due date, within the limits set by the card schemes. We do not charge a fee for a failed payment or a retry.
If no payment can be collected after the final retry, the subscription is suspended and Premium features stop. You are not charged for any period during which the subscription is suspended. You can restart at any time by adding a valid payment method.
Where your card is replaced or re-issued, our payment service provider may receive the new details automatically through the card schemes’ account updater services, so that your subscription continues without interruption. If you do not want this, cancel the subscription or remove the saved card.
10. How to cancel
You can cancel at any time, and cancelling is as easy as subscribing. There is no cancellation fee and no need to call us, write a letter or give a reason.
- By the “cancel” link included in your confirmation email and in every receipt and reminder we send.
- By email to support@luvio.club from the address registered on your account. We action cancellations received by email within 4 business days and treat them as effective from the date you sent them.
We email you a confirmation once a subscription is cancelled. After cancelling, you keep access to Premium features until the end of the period you have already paid for, and no further payment is taken. Cancelling the subscription does not delete your Luvio account; you can continue to use the free features.
11. Changes to the arrangement
We may change the price, the billing interval or the features included in a plan. Any such change is notified to you in advance under section 7 and applies only from your next billing period. You may cancel before the change takes effect, and if you do, you are not charged the new amount. If you do not cancel, you are taken to have accepted the change.
12. Refunds on a recurring payment
Refunds are dealt with in our Payment Policy. In addition, if you were charged for a renewal you did not intend and you have not used any Premium feature in that billing period, contact support@luvio.club within 14 days of the charge and we will refund it in full.
13. Security of stored card details
- Card details are stored as a token by our PCI DSS compliant payment service provider. Luvio does not hold your full card number, expiry date or security code.
- A stored token can be used only within the Luvio payment environment and only for the purposes described in section 3.
- Every transaction is submitted with the stored-credential indicators required by the card schemes, including the identifier of the original transaction in which you gave consent, so that your issuer can recognise it as an agreed recurring payment.
- Your first payment and, where required, subsequent payments are authenticated with 3-D Secure.
14. Records
We retain the record of your consent, the confirmation and reminder notices sent to you, and the receipts for each payment, for at least 12 months after the arrangement ends, or longer where the law or our payment service provider requires it. You can ask for a copy at any time by emailing support@luvio.club.
15. Changes to this Policy
The version of this Policy in force is published at www.luvio.club/recurring-policy with the date it was last updated. Where a change materially affects an existing subscription, we notify affected users by email at least 10 days in advance.
